Member Relationship

1. A member shall not in the course of advertising, public relations efforts, or any other activity permit the demeaning or criticising in any manner whatsoever of any other private employment agency or personnel consulting firm.

2. A contractor, client or member who has a complaint about another employment agency or consulting firm may file the complaint with the Secretary of the Association who will refer it to the Ethics Committee for action. SUCH REFERRAL WILL OCCUR WITHIN ONE WORKING DAY OF NOTIFICATION.

3. THE ETHICS COMMITTEE WILL INTERVIEW THOSE MEMBERS INVOLVED WITHIN ONE FURTHER WORKING DAY AND IF NO CLEAR RULING MAY BE GIVEN WITHOUT DISCUSSING THE MATTER WITH A CLIENT OR APPLICANT, THEN SUCH DISCUSSION WILL BE ENTERED INTO. THE MEMBER OF THE ETHICS COMMITTEE (VOTED BY A MAJORITY OF THE COMMITTEE) WILL CONTACT THAT CLIENT/APPLICANT AND WILL ONLY IDENTIFY THEMSELVES AS A MEMBER OF MTPC WHICH IS TO PROTECT THE INTERESTS OF CLIENTS, APPLICANT AND MEMBERS. HE/SHE WILL NOT DISCUSS WHAT OUR MEMBERS HAVE STATED BUT WILL INDICATE THERE IS A DISPUTE AND WOULD ASK ANY RELEVANT QUESTIONS SUCH THAT IN NO WAY WOULD A MEMBER BE PUT INTO DISREPUTE. UPON SUCH SUITABLE ANSWERS BEING GIVEN, THE MEMBER WILL REPORT TO THE COMMITTEE FOR A RULING.

TO FURTHER THE EFFECTIVENESS OF THESE PROCEDURES EACH MEMBER SHALL BE RESPONSIBLE FOR BRINGING TO THE ATTENTION OF THE ASSOCIATIONS ETHICS COMMITTEE ANY VIOLATION OF THESE STANDARDS. IT SHOULD BE ALSO POINTED OUT THAT WHEREVER POSSIBLE A CLIENT SHOULD NOT BE CONTACTED.

4. There will be an automatic barring of a member from the Ethics committee during the investigation of any complaint involving any member with whom the member has any affiliation. In the case of a dispute between members, the Association will act as an arbitrator and its decision shall be binding. In the case of a dispute between members and others, the Association shall act as an arbitrator if so requested by the third party.

5. ANY MEMBERS FOUND GUILTY OF BREACHING THE CODE OF ETHICS WILL BE GIVEN A WARNING. AFTER 3 WARNINGS A MEMBER AUTOMATICALLY LOSES ITS MEMBERSHIP UNLESS A MINIMUM OF 75% OF MEMBERS OF THE MTPC VOTE OTHERWISE. UPON 3 BREACHES BEING REACHED, AN ADVERTISEMENT IN THE AGE WILL BE PLACED IN EITHER "D" FOR DRAFTING OR "A" FOR ARCHITECTURAL (DEPENDENT UPON THE INDUSTRY THE MEMBER IS ACTIVE IN) STATING THEIR LOSS OF MEMBERSHIP FOR BREACHING THE CODE OF ETHICS ON NO LESS THAN 3 OCCASIONS. THIS AD WILL BE PLACED WITHIN ONE WEEK OF THE MEMBERS LOSS OF MEMBERSHIP AND WILL BE REPEATED WITHIN 2 WEEKS OF THE ORIGINAL PLACEMENT. SUCH AD WILL BE 1 COLUMN WIDE X 8CM DEEP, PLACED IN THE PROFESSIONAL EMPLOYMENT SECTION OF THE AGE.

NOTE: ALTERATIONS TO THIS COULD INCLUDE FINES - UP TO $1,000 SUSPENSION OF MEMBERSHIP AND LOSS OF MEMBERSHIP WITH NOTIFICATION TO CONSUMER AFFAIRS AND ADVERTISEMENT TO THAT EFFECT.
